The Parliament of Ukraine adopted the Renewable Auction Law (8449-D) that introduces new support system for renewable energy projects.<\/p>\n

Key provisions of the adopted Law are as follows:<\/p>\n\n\n\n\n\n\n\n\n\n\n\n\n\n\n\n\n\n\n
Date of new support scheme introduction<\/td>\n\u00a001 July 2019<\/td>\n<\/tr>\n
Pilot auctions<\/td>\nTo conduct a pilot auction during 6 months from the effective date of the Law; on or before 31 December 2019. The Cabinet of Ministers of Ukraine decides on the quota size for the pilot auction.<\/td>\n<\/tr>\n
Annual auctions<\/td>\nAnnual auctions from 01 January 2020<\/td>\n<\/tr>\n
Support for the successful bidder<\/td>\n20 years<\/td>\n<\/tr>\n
Allocation of annual quota by RES types<\/td>\nAnnual quota is allocated by shares by separate RES types with following minimum level:
\n\u00b7\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 for wind \u2013 not less than 15%
\n\u00b7\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 for solar \u2013 not less than 15%
\n\u00b7\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 for other RES types (biomass, biogas, hydro-, geothermal) \u2013 not less than 15%
\nDuring the auction, RES competition is ensured within these groups.<\/td>\n<\/tr>\n

Auction design<\/p>\n

One-stage sealed-bid auction. The bidders shall submit closed bids containing the technical bid (capacity) and the price bid (electricity price per 1 kilowatt hour).<\/td>\n<\/tr>\n
Auction ceiling price<\/p>\n

 <\/td>\n

\u201cGreen\u201d tariff for corresponding RES technology (WPP, SPP) as of the auction date
\nAs for other RES types (biomass, biogas, hydro, geothermal), auction ceiling price cannot exceed the \u201cgreen\u201d tariff for biomass as of 01.01.2020.<\/td>\n<\/tr>\n
Bid bond<\/td>\nEUR 5\/1 kW to participate in the auction
\nEUR 15\/1 kW to be provided in case of auction winning as the guarantee of contractual obligation fulfilment. In addition, the bid bond for participation in the auction will be refunded.<\/td>\n<\/tr>\n
Responsibility for imbalances<\/td>\nFull responsibility after recognition of the intra-day market to be liquid (the Regulator shall decide on liquidity); from 2024 by latest.<\/td>\n<\/tr>\n
Final date to sign a pre-PPA to complete the launched RES projects using the \u201cgreen\u201d tariff scheme (regardless of the project size)<\/p>\n

By 31 December 2019.
\nTerms and conditions for the pre-PPA conclusion:
\n\u2022\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 confirmed right for land ownership\/use;
\n\u2022\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 concluded grid connection agreement for the facility;
\n\u2022\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 construction permit.<\/td>\n<\/tr>\n
\u201cGreen\u201d tariff term<\/td>\n\u201cGreen\u201d tariff is valid until 2030 only<\/td>\n<\/tr>\n
\u201cGreen\u201d tariffs for SPPs<\/td>\nDecrease for SPPs in 2020 is 25% with a further decrease by 2.5% annually during 3 years.<\/td>\n<\/tr>\n
\u201cGreen\u201d tariffs for WPPs<\/td>\nDecrease for WPPs in 2020
\n\u2013\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 for turbines with the installed capacity exceeding 2 MW – decrease by 10% (without further annual decrease)
\n\u2013\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 for turbines up to 600 kW, from 600 kW to 2,000 kW – decrease by 10% (with a further decrease by 1.5% annually during 3 years)<\/td>\n<\/tr>\n
\u201cGreen\u201d tariffs for biomass, biogas<\/td>\nCurrent \u201cgreen\u201d tariff shall be valid during 2020-2030<\/td>\n<\/tr>\n
\u201cGreen\u201d tariffs for micro-, mini-, small HPPs, and geothermal facilities<\/td>\n10% decrease of the \u201cgreen\u201d tariff in 2020<\/td>\n<\/tr>\n<\/tbody>\n<\/table>\n
